About the Program

The legalization of hemp under the 2018 Farm Bill spawned a category of consumer products containing intoxicating compounds such as delta-8 THC that produce psychoactive effects similar to those produced by the delta-9 THC in federally unlawful marijuana. But are they legal? Did Congress intend for hemp to be converted into intoxicating compounds? Delta-8 and similar compounds are being regulated differently from state to state. Likewise, courts in different jurisdictions have treated their legality differently. Congress could address what some claim is a “loophole” in the 2018 Farm Bill’s definition of hemp in the upcoming farm bill.

Join us as we discuss that perceived loophole, the conversion of hemp into intoxicating compounds, recent legal decisions regarding their legality, and how the forthcoming farm bill might clear up the confusion.
