PHILADELPHIA, August 6, 2025—Duane Morris LLP represented Presperse Corporation, a subsidiary of Sumitomo Corporation of Americas, in the resolution of its Chapter 11 case less than a year after the company filed for bankruptcy in September 2024. Judge Michael B. Kaplan of the U.S. Bankruptcy Court for the District of New Jersey and Judge Robert Kirsch of the U.S. District Court for the District of New Jersey approved Presperse’s Chapter 11 plan, resolving current and future claims stemming from its talc products. Presperse is the first company involved in talc litigation to successfully file for and emerge from Chapter 11 using Section 524(g) of the Bankruptcy Code, including the establishment of a trust and channeling injunction. The plan received unanimous support from all voting talc claimants.
Morris S. Bauer in Northern New Jersey and Drew S. McGehrin in Philadelphia were counsel to Presperse Corp., working with David M. Fish, Director of Litigation at Sumitomo Corporation of Americas.
