CHICAGO, February 18, 2025—Duane Morris LLP has released the Privacy Class Action Review – 2025, which analyzes the key privacy-related rulings, settlements and litigation developments in 2024 and the significant trends that are apt to impact these types of class actions in 2025. Edited by Duane Morris partners Gerald L. Maatman Jr., Jennifer A. Riley, Alex W. Karasik and Gregory Tsonis, special counsel Justin Donoho and senior associate Tyler Zmick, the Privacy Class Action Review – 2025 reflects a broad array of “lessons learned” from their extensive experience in defending privacy class action litigation throughout the United States.
“Privacy class action litigation ranks near the top of the list of issues that keep corporate counsel up at night,” says Maatman. “The significant stakes in these cases and the evolving legal landscape in privacy class action rulings and legislation make the defense of privacy class actions a challenge for corporations.”
Karasik adds that the review offers analysis on recent decisions in two distinct areas: litigation regarding “biometric” technologies under the Illinois Biometric Privacy Act (BIPA) and claims regarding website advertising technologies (aka adtech) asserted under a variety of federal and state statutory and common laws, which are at the forefront of the growing area of litigation.
Riley opines that the plaintiffs’ class action bar has continued to invest in the privacy class action space and, over the past year, has generated a multitude of filings, making privacy one of the hottest areas of growth in terms of activity by the plaintiffs’ class action bar. Riley asserts that “companies can expect these types of class actions to continue their explosive growth in 2025.”
Tsonis states, “Privacy law is rapidly evolving. Many governments and regulatory bodies are developing stricter privacy regulations, and courts are becoming more inclined to hear class actions related to privacy.”
Donoho adds, “The increase in these lawsuits highlights the increasing importance of ensuring compliance with a variety of privacy laws and otherwise mitigating risk by modernizing online data privacy policies and terms of service.”
“Privacy class actions can have a significant impact on companies, both financially and reputationally,” concludes Zmick.
