CHICAGO, March 4, 2025—In 2024, actions under the California Private Attorneys General Act (PAGA) saw their first setback as a workaround to workplace arbitration programs that require individual proceedings. To assist with understanding what this means for employers facing PAGA claims, Duane Morris LLP has released the Private Attorneys General Act Review – 2025, the next edition of this annual publication. It analyzes the key PAGA rulings and litigation developments in 2024 and the significant trends that are apt to impact these types of representative actions in 2025.
According to data maintained by the California Department of Industrial Relations, the number of PAGA notices filed with the California Labor and Workforce Development Agency has increased exponentially over the past two decades. At the same time, the plaintiffs’ bar in California used PAGA actions to get around workplace arbitration agreements with class action waivers on the grounds that PAGA claims were somehow different than class actions and not covered by arbitration defenses. But the PAGA workaround has suffered significant setbacks in recent years.
