Julian A. Jackson-Fannin is an attorney in Duane Morris’ Miami office practicing in the area of commercial litigation. Mr. Jackson-Fannin has litigated complex matters in both state and federal courts. During his career, he has advised and represented companies of all sizes as well as individuals in a variety of commercial matters, including contract disputes, copyrights, employment disputes, administrative and regulatory challenges, creditor’s rights matters, and class action consumer protection disputes.

Prior to joining Duane Morris, Mr. Jackson-Fannin clerked for the Honorable Donald L. Graham, Senior United States District Judge, at the United States District Court for the Southern District of Florida. Mr. Jackson-Fannin also served as an Assistant Public Defender in Florida’s Twelfth Judicial Circuit, where he represented indigent clients as lead and secondary trial counsel on numerous misdemeanor and felony cases.

Mr. Jackson-Fannin is a 2011 cum laude graduate of Florida A&M University College of Law, where he was Editor-in-Chief of the Florida A&M University Law Review, and a graduate of Emory University.

Representative Matters

  • Defended a healthcare network management company against claims by its former CEO who alleged that the company failed to pay him a transaction bonus he claims was due and failing to accelerate other payments to him as a result of a complex financial transaction.

  • Solidified win for healthcare network management company in two rounds of appeal arising out of defense of an arbitration involving claims of fraudulent inducement, negligent misrepresentation, and four separate breach of contract claims.

  • Won dismissal with prejudice for a large U.S. Bank in Florida State Court, Pinellas County, Florida in a dispute alleging breach of contract, breach of fiduciary duty, and negligence.

  • Represented energy company against claims brought under the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act and the Junk Fax Prevention Act. Case was successfully resolved through early mediation.

  • Represented media company specializing in B2B sales and marketing advertisements against claims brought by putative class under the Florida Telephone Solicitation Act. Obtained a “walk-away” resolution pre-suit.

  • Represented Newsmax Media and secured dismissal of a defamation claim against brought by Dr. Jerome Corsi, an author and political commentator, on a motion to dismiss/for summary judgment brought under Florida’s anti-SLAPP law, which was granted on procedural grounds.

  • Represented clinics in state challenges to Medicaid participant resulting in a TRO against the state for excluding provider.

  • Representing owners of a high-end luxury resort located in the US Virgin Islands in a case arising out of an extermination company’s unlawful use of a fumigant that caused devastating and permanent injuries to a family exposed to the chemicals. The owners of the resort have suffered damage to the value of the resort property.

  • Representing clients in a suit brought in Federal Court seeking damages for an alleged breach of an agreement for the removal and disposal of scrap materials and debris throughout the US Virgin islands that arose from the 2017 hurricanes.

  • Represented a client in state court in Miami, Florida for a breach of a real estate sales contract that involved the failure to pay a deposit to purchase a luxury residential property.

  • Represented nationwide funeral home company in breach of employment contract suit brought by top executive. The arbitrator decided in favor of the funeral home company on the breach of employment contract claim. (American Arbitration Association 2018).

  • Represent and advise content creators, including photography studios, publishers and media companies, to protect and enforce copyrights and other intellectual property rights in their content.

  • Successfully defended clients against copyright infringement claims arising out of content posted on their business websites.

  • Successfully represented an on-line home security company to obtain a permanent injunction and other relief in a copyright infringement claim in the Southern District of Florida against a competitor home security company arising out of the unauthorized use of our client’s specially created product photographs.
