Duane Morris partner Seth Goldberg and associate Jim Halligan, both members of the firm’s Trial Practice Group in its Philadelphia office, authored this article on the growing market for life settlements, transactions in which the owners of life insurance policies sell unneeded policies to third parties for more than their cash value, but less than their face value. The third parties then pool the policies and resell them, either in full or as partial interests, to investors. Goldberg and Halligan outline the most recent developments for the financial products in the SEC and the courts, particularly regarding consumer and investor protections, underwriting practices and other regulatory concerns.
