John T. Schriver practices in the areas of general corporate litigation, securities transactions, distributorship problems, professional liability, trade secrets litigation, employment and labor claims, disputes under the Uniform Commercial Code and construction litigation.
Mr. Schriver has significant experience in chancery court matters, particularly injunctive actions. He has also successfully argued cases involving such issues as breach of contract, estoppel and consumer fraud. Admitted to practice in Illinois and Florida, Mr. Schriver is a member of the Litigation Section of the American Bar Association, the Florida and Illinois State bar associations.
He is a 1971 graduate of Georgetown University Law Center and a graduate of the College of the Holy Cross.
Representative Matters
- ValuePart v. ITR - Plaintiff claimed former CEO took trade secret information with him to start a competing business. The case revolved around E-discovery issues and resulted in a 42-page opinion on the need to preserve all evidence once a lawsuit is threatened. We were successful in defeating both a TRO petition and a motion for a preliminary injunction. After the federal judge indicated that he would not issue an injunction, the case settled favorably.
- Moore v. Suburban Financial Management Corp. - Trial arising out of a plaintiff's claims for violation of the Illinois Wage Payment Act. At the conclusion of the plaintiff's case the circuit court judge granted two of our three motions for a directed finding. The case settleed very reasonably before the defense began their case.
- Stearns v. Cutler - Plaintiffs sued the attorney/trustee of their grandfather's trust for mismanagement of the trust assets and also for an accounting. The court ordered the accounting and, based on the accounting, entered summary judgement, surcharging the trustee for the full amount of the trust corpus, plus interest from 1996 to the present.
- Just Ducky v. Prior and Upper Class Collectibles - Plaintiff sued Prior, a major league pitcher for the Chicago Cubs, and a memorabilia company for breach of contract arising out of a failed autograph show at plaintiff's store in 2004. At the conclusion of the case the circuit judge found defendants liable for $32,000, less than the amount defendants had offered in settlement and the court further specifically found that defendant Prior had lived up to all of his obligations under the contract at the night of the event, an issue that reflected on Prior's reputation as this was widely reported in the media.
